FateTell Terms of Service

Welcome to the FateTell platform (hereinafter referred to as "FateTell" or "this Platform"), which is operated by Hong Kong AuraAI Technology Limited (hereinafter referred to as "FateTell Company" or "we"). Before using the various services provided by the FateTell platform (including its website, iOS application, and other forms), please carefully read and fully understand the contents of each provision of this agreement.

If you do not agree to this Terms of Service and/or any modifications thereto at any time, you may voluntarily cease using the services provided by FateTell. Once you use the services provided by FateTell (including downloading, installing, launching, browsing, registering, logging in, purchasing, and other such actions), you shall be deemed to have understood and fully agreed to all provisions of this Terms of Service, including any modifications to this Terms of Service made by FateTell at any time, and to have become our user.

I. General Provisions

1.1 This agreement is entered into regarding your registration, login, and use of FateTell services.

1.2 Users may use individual services of various channels and products of FateTell, which may be provided to you by FateTell Company, its affiliated companies, or its controlling companies. When users use individual services of FateTell, such usage shall be deemed as the user's consent to the terms of service of such individual service and all announcements issued by FateTell in connection with such individual service.

1.3 The FateTell user agreement and the individual service terms and announcements (if any) of various channels and products may be updated by FateTell at any time without further notice. When using the relevant services, you should pay attention to and comply with the applicable terms.

II. Account Registration and Use

You are required to register a FateTell account to use certain FateTell products or services. When you register and use an account, you shall comply with the following requirements:

2.1 Upon successful registration, FateTell will assign each user a user account, and users may set their own account password. The user account and password shall be safeguarded by the user; users shall bear legal responsibility for all activities and events conducted under their user account.

2.2 The ownership of FateTell accounts belongs to FateTell Company. After filling in information as guided by the registration page, reading and agreeing to this agreement, and completing all registration procedures, you may obtain a FateTell account and become a user, and may use the FateTell account and products. Users shall provide timely, detailed, and accurate personal information, and shall continuously update their registration information to meet the requirements of timeliness, completeness, and accuracy. All originally entered information shall be treated as registration information. FateTell Company shall not bear any responsibility for problems arising from untrue registration information or untimely updates. You may query and correct your information through the FateTell account settings page. Users shall authenticate their accounts with real identity information, and the account name, avatar, and profile information submitted by users shall not contain any illegal or inappropriate content. After review by FateTell Company, if any of the above circumstances exist, FateTell Company will not approve the registration. Furthermore, after registration, if it is discovered that a user has fraudulently obtained an account name through false information, or that the user's account avatar, profile, or other information contains illegal, non-compliant, or inappropriate content, FateTell Company reserves the right to unilaterally take measures without notice, including but not limited to requiring correction within a specified period, deleting/resetting avatar information, suspending use, deregistering the account, and reclaiming the account.

2.3 Based on the requirements of applicable laws and regulations or FateTell service policies, you may be required to provide your real name, contact information, identification number, and other information when using certain FateTell services. You shall guarantee the authenticity of the identity information you provide, and use real, accurate, lawful, and valid identity documents and necessary information. Please complete and timely update the above information in accordance with applicable regulations. If the materials you submit or the information you provide are inaccurate, untrue, non-compliant, or unlawful, or if FateTell Company has reason to suspect that such materials are erroneous, false, or unlawful, FateTell Company reserves the right to refuse to provide you with the relevant services, and you may be unable to use FateTell-related services or have certain functions restricted during use.

2.4 To satisfy mandatory requirements of laws and regulations, for the necessity of providing products or services, or based on the need for risk identification and enhanced verification of your account, when you use facial recognition login or verification functions, we will collect and store your facial photos and information. You shall complete the corresponding actions as prompted on the page, and after the FateTell system determines that your actions meet the requirements, facial capture shall be completed. You agree that only you yourself may use the facial recognition login and verification services for your own FateTell account. To improve verification accuracy, you agree that FateTell may, when necessary, compare and verify your facial photos and facial features provided to FateTell against the facial features stored by institutions permitted by laws and regulations or institutions authorized by government authorities.

2.5 A FateTell account consists of an account name and password. You may log in using the account name you have set (including username, mobile phone number, or email address) and password. During account use, in order to safeguard your account security across different terminals and in accordance with your usage habits, we may adopt different verification measures to identify your identity. For example, when your account logs in on a new device for the first time, we may verify your identity through password plus verification code; verification methods include but are not limited to SMS verification codes and service usage information verification.

2.6 Users shall not transfer, sell, or lend their account or password to others for use. Account usage rights belong solely to the initial registrant, and users shall independently bear full responsibility for all activities conducted under their account. If FateTell reasonably determines that the relevant account is involved in account trading or is at risk of account theft, FateTell reserves the right to independently take measures such as freezing or banning the account. If account disputes arise due to account transfer, sale, or lending, or if FateTell is unable to determine account ownership, FateTell reserves the right to refuse to provide account recovery services. Once such reports or complaints are received, FateTell reserves the right to immediately freeze or ban the account.

2.7 You shall properly safeguard your account and password. You shall not trust online messages requesting loans, soliciting passwords, or involving property matters. You shall not disclose your FateTell account, password, or verification codes sent to you by FateTell to others, nor shall you enter your FateTell account, password, or verification code information on non-FateTell websites, or log in through QR code scanning or similar methods on non-FateTell websites. Otherwise, your account may be compromised and your property may suffer losses. Losses caused by your improper safeguarding of your account shall be borne by you. At the same time, when such circumstances occur and FateTell is unable to reasonably determine account ownership, we will be unable to recover your account.

2.8 If your account becomes inaccessible due to personal reasons and you need to recover your FateTell account, please provide the corresponding information in accordance with FateTell's account recovery requirements, and ensure that the information provided is lawful, true, and valid. If any of the following circumstances exist:

The information provided does not meet the requirements;
The unique credential of the account is no longer valid;
FateTell Company's security verification cannot be passed;
There are security risks such as account theft, or other circumstances that prevent the determination of account ownership, FateTell Company reserves the right to refuse to provide account recovery services and may take measures such as freezing or banning the account as appropriate.

If the mobile phone number bound to your FateTell account ceases to be in use due to personal reasons, please promptly change the bound mobile phone number on your FateTell account. Otherwise, if the telecommunications carrier reassigns the number, subsequent users of that mobile phone number may log in through your original number and access all of your account information and product usage information. Your FateTell account will no longer be usable, and there is a risk of personal information leakage. Please ensure that you change your bound mobile phone number in a timely manner. Any responsibility arising from account loss or personal information leakage due to failure to timely change the bound mobile phone number shall be borne by you. FateTell Company reserves the right to refuse to provide account recovery services and may take measures such as freezing or banning the account as appropriate.

2.9 When you need to terminate the use of FateTell account services and the following conditions are met, you may apply to deactivate your FateTell account. Account deactivation is irrevocable and irreversible; please proceed with caution. Please be aware of and confirm the following:

You may only apply to deactivate your own account and shall proceed with deactivation in accordance with FateTell's procedures;
You shall continue to bear corresponding responsibility for your conduct prior to account deactivation and during the period of using FateTell services;
Please back up relevant information and data before deactivation. After successful deactivation, unless otherwise provided by laws or regulations or otherwise agreed upon by both parties, account information, personal identification information, transaction records, membership benefits, stored information, and other information bound to or associated with the account shall not be recoverable, restorable, or retrievable. You shall no longer be able to log in through the original account (even if you re-register using the same mobile phone number or can prove that you are the original account holder) or perform any operations, and your newly registered account shall not be able to use the original account's username.

2.10 To prevent resource misuse, if you have not used your FateTell account for six consecutive months or have not logged into your FateTell account through any other method recognized by FateTell Company, FateTell Company reserves the right to reclaim such account, and you shall no longer be able to log into this website or use the related services through that account. If the account has associated pending transactions or a remaining balance, FateTell Company will assist you in handling them within a reasonable scope. Please proceed in accordance with the instructions provided by FateTell Company.

2.11 We will use the information you submit and retain when registering your FateTell account and using FateTell services in accordance with FateTell Company's Privacy Policy (https://fatetell.com/privacyPolicy). You warrant that before using all products and services of FateTell Company, you have fully understood and agreed that FateTell Company may process user information accordingly.

2.12 To satisfy the requirements of applicable laws and regulations and to safeguard your account security, especially when you perform sensitive operations such as unbinding or deactivating your account, we may send the personal identity information you have submitted to banks, telecommunications carriers, and other institutions for verification inquiries to confirm the authenticity of your identity. Subject to compliance with laws and regulations, or upon the request of governmental authorities, we reserve the right to restrict or freeze your account. In such cases, you may be unable to continue logging into or using your account. If applicable regulations also require or recommend that we conduct further account authentication procedures, please cooperate accordingly. To comply with the requirements of regulatory authorities, law enforcement agencies, and judicial departments, or as necessary for the handling of litigation or disputes related to you (if any), we may provide information related to your account to regulatory authorities, law enforcement agencies, or judicial departments, including but not limited to your registration information, login information, real-name authentication information, binding information, and other relevant information that may reflect your account ownership and usage.

2.13 You shall register and use your FateTell account in a reasonable manner and shall not maliciously register or improperly use your FateTell account. Common violations include but are not limited to: frequent registration, batch registration, and other behaviors that can reasonably be deemed to constitute automated account operations; malicious abuse of multiple accounts; malicious assistance in verification or account recovery; using a FateTell account to engage in activities that are illegal, in violation of this agreement, or in violation of other product agreements or rules of FateTell Company (and its affiliated companies); or using a FateTell account for other improper purposes.

2.14 You must register your FateTell account through official FateTell channels and shall not register or obtain a FateTell account or its login credentials through any unofficial channels. You shall not engage in conduct that violates laws and regulations, this agreement, or other product agreements of FateTell (and its affiliated companies) by controlling multiple accounts. You shall not use any means to circumvent, counter, or undermine the platform's registration, login, and usage rules. We reserve the right to make independent judgments regarding the above malicious registration and improper use behaviors and, when we reasonably determine that such behaviors exist, to unilaterally take remedial measures. Such measures include but are not limited to: deleting user-published content, suspending usage licenses, terminating services, restricting use, prohibiting login, prohibiting account rebinding, prohibiting appeals, reclaiming FateTell accounts, freezing/banning FateTell accounts, and pursuing legal liability — all measures that FateTell deems appropriate to reasonably address abusive behaviors and protect the platform and user account security. If users have evidence proving that they have not engaged in the above abusive behaviors, they may file an appeal through the contact channels specified in this agreement.

2.16 You understand that we reserve the right to make independent judgments regarding account behaviors that the platform determines to involve fraud, abnormal operations, cheating, or security risks, and to unilaterally take remedial measures, including but not limited to: restricting login, requiring completion of real-name information, freezing accounts, banning accounts, and reporting or referring the matter to relevant regulatory authorities for handling.

2.17 We reserve the right to make independent judgments regarding any malicious registration, abnormal risk behavior, illegal or non-compliant conduct, violation of agreement terms, or violation of public order, morality, and social norms, and when we reasonably determine that such behaviors exist, to unilaterally take remedial measures. Such measures include but are not limited to: deleting user-published content, requiring corrections, suspending usage licenses, terminating services, restricting use, prohibiting login, prohibiting account rebinding, prohibiting appeals, reclaiming FateTell accounts, freezing/banning FateTell accounts, and pursuing legal liability — all measures that FateTell deems appropriate to reasonably address abusive behaviors and protect the platform and user account security. For users who repeatedly violate the relevant rules and fail to correct their conduct, we reserve the right to directly ban the account and publicly disclose the relevant handling results. If users have evidence proving that they have not engaged in the above abusive behaviors, they may file an appeal through the contact channels specified in this agreement.

III. Usage Rules

3.1 When using the services of FateTell Company, users must comply with the Cybersecurity Law, the Anti-Telecom Network Fraud Law, the Measures for the Security Protection and Administration of International Networking of Computer Information Networks, the Measures for the Administration of Internet Information Services, the Provisions on the Administration of Internet User Account Information, the Provisions on the Ecological Governance of Network Information Content, the Decision on Safeguarding Internet Security, the Provisions on the Administration of Internet News Information Services, the Yangtze River Protection Law, the Surveying and Mapping Law, the Measures for the Administration of Internet Religious Information Services, and other applicable laws and regulations of the People's Republic of China or other relevant countries and regions. Users agree that they will not use this service for any illegal or improper activities, including but not limited to the following:

Uploading, displaying, posting, disseminating, or otherwise transmitting information containing any of the following:

Content that opposes the fundamental principles established by the Constitution;
Content that endangers national security, divulges state secrets, subverts state power, or undermines national unity;
Content that damages national honor and interests;
Content that distorts, defames, desecrates, or denies the deeds and spirit of heroes and martyrs, or infringes upon the names, likenesses, reputations, or honors of heroes and martyrs through insult, defamation, or other means;
Content that promotes terrorism or extremism, or incites terrorist or extremist activities;
Content that incites ethnic hatred, ethnic discrimination, or undermines ethnic unity;
Content that undermines national religious policies, including proselytizing, conducting religious education and training, publishing or forwarding sermons or religious content, organizing religious activities, live-streaming or recording religious ceremonies, establishing religious organizations, setting up religious institutions and places of worship, recruiting followers, conducting fundraising in the name of religion, or promoting cults and feudal superstition;
Content that spreads rumors, disrupts social order, or undermines social stability;
Content that disseminates obscenity, pornography, gambling, violence, murder, or terror, or that incites criminal activity;
Content that insults or defames others, or infringes upon the reputation, privacy, or other lawful rights of others;
Content that is false, fraudulent, harmful, threatening, invasive of others' personal information, harassing, defamatory, vulgar, obscene, or otherwise morally objectionable;
Illegal or non-compliant content related to destructive fishing methods such as electric fishing, poison fishing, or blast fishing that damage fishery resources and the ecological environment (including but not limited to text, images, animations, and videos);
Content that may infringe upon national sovereignty and territorial integrity, or that violates state regulations concerning map compilation and publication;
Other content that is restricted or prohibited by applicable laws, regulations, rules, ordinances, and any other legally binding norms;

The network service system shall not be used for any unlawful purpose;
FateTell Company's services shall not be used to engage in the following activities:

Accessing a computer information network or using computer information network resources without authorization;
Deleting, modifying, or adding to computer information network functions without authorization;
Deleting, modifying, or adding to data and application programs stored, processed, or transmitted in computer information networks without authorization;
Intentionally creating or disseminating computer viruses or other destructive programs;
Other conduct that endangers the security of computer information networks.

3.2 When producing or publishing online information content through your account, you shall comply with applicable requirements and shall not create, publish, reproduce, or redistribute harmful information containing any of the following:

Content with sensationalized titles where the content seriously deviates from the title;
Content that hypes up gossip, scandals, or misconduct;
Content that inappropriately comments on natural disasters, major accidents, or other calamities;
Content containing sexual innuendo, sexual provocation, or other content that readily provokes sexual associations;
Content displaying bloody, horrifying, or cruel imagery that causes physical or psychological discomfort;
Content that incites group discrimination, regional discrimination, or similar prejudice;
Content that promotes vulgarity, mediocrity, or pandering;
Content that may induce minors to imitate unsafe behaviors or conduct that violates public morality, or that fosters unhealthy habits among minors;
Other content that adversely affects the online ecosystem.

3.3 If users violate this agreement or the relevant terms of service, resulting in any claims, demands, or losses asserted by any third party, including reasonable attorney's fees, you agree to indemnify and hold harmless FateTell Company, its partner companies, and its affiliated companies. In such cases, FateTell Company reserves the right, depending on the nature of the user's conduct, to take measures including but not limited to: deleting user-published content, suspending usage licenses, terminating services, restricting use, reclaiming FateTell accounts, and pursuing legal liability. Users shall not copy, reproduce, sell, resell, or use any part of this service, or the use or access thereof, for any other commercial purpose. Users shall bear legal responsibility for their conduct in the course of using FateTell Company's services. Forms of legal responsibility borne by users include but are not limited to: compensating the aggrieved party, and in the event that FateTell Company first bears administrative penalties or compensation for infringement damages resulting from user conduct, the user shall provide FateTell Company with equivalent compensation.

3.4 You acknowledge and agree that the services, answers, and other information provided to you by FateTell are derived from your location, celestial movements, time, and other information through specific computer algorithms and computational tools. Due to the limitations of the underlying theories and computer algorithms, the above information and data are for reference only. You should exercise caution when relying on the relevant information within FateTell and any inferences or analyses based thereon. When you make judgments, choices, or take any actions based on the above information, you shall independently bear the consequences thereof. FateTell shall not bear any liability for your actions arising from the provision of such information.

3.5 You acknowledge and agree that, in order to improve your experience, FateTell may enhance the algorithms and programs of related platform functions based on innovations and developments in the theories and technologies of relevant fields. This may result in changes to all or part of the data and information displayed on the platform that pertains to you. FateTell shall not bear any liability to you arising from such changes in data or information.

IV. Service Content

4.1 FateTell is an online product, and the specific content of its services is provided by FateTell Company based on actual circumstances.

4.2 Unless otherwise expressly provided in this Terms of Service, all new products, new features, and new services released by FateTell Company shall be governed by this Terms of Service.

4.3 To use this service, you must be able to independently access the internet through a third party that is legally qualified to provide internet access services to you, and you shall bear the relevant service fees yourself. In addition, you must independently provide and be responsible for all necessary equipment required for internet connection, including computers, modems, and other access devices.

4.4 Given the special nature of online services, users agree that FateTell Company reserves the right to change, interrupt, or terminate part or all of the online services (including paid online services) at any time without prior notice. FateTell Company does not guarantee that online services will not be interrupted, nor does it make any guarantees regarding the timeliness, security, or accuracy of online services.

4.5 Disclaimer: FateTell Company shall not be liable for interruptions of online services within a reasonable timeframe caused by the following circumstances:

FateTell Company needs to perform regular or irregular inspections, repairs, or maintenance on the platform or related equipment providing online services. FateTell Company reserves the right to suspend any part of this service without prior notice for the purposes of maintenance, servicing, upgrades, or other purposes.
Force majeure events such as typhoons, earthquakes, floods, lightning strikes, or terrorist attacks;
Failures in the user's computer hardware and software, communication lines, or power supply lines;
Viruses, Trojan horses, malicious program attacks, network congestion, system instability, system or equipment failures, communication failures, power failures, banking issues, third-party service defects, or government actions.

Notwithstanding the foregoing, FateTell Company shall take reasonable measures to actively promote the restoration of normal services.

4.6 This service or third parties may provide links to other websites or resources on the internet. Since FateTell Company has no control over such websites and resources, you understand and agree that FateTell Company is not responsible for the availability of such websites or resources. FateTell Company makes no representations or warranties regarding, and assumes no responsibility for, any content, advertisements, products, or other materials existing on or originating from such websites or resources. FateTell Company shall not be liable for any damages or losses arising from the use of or reliance on any content, goods, or services published on or obtained through such websites or resources.

4.7 Users expressly agree that all risks associated with the use of FateTell Company's online services shall be borne entirely by themselves. Users understand and accept that any information or materials downloaded or obtained through FateTell Company's services are at the user's own discretion, and the user bears the risks of system damage, data loss, and any other risks.

4.8 FateTell Company reserves the right at any time to temporarily or permanently modify or terminate this service (or any part thereof), whether or not notice is given. FateTell Company shall bear no liability to users or any third party.

4.9 Termination of Service: You agree that FateTell Company may, at its sole discretion, for any reason, including but not limited to extended non-use (exceeding one year), or if FateTell Company believes that you have violated the letter and spirit of this Terms of Service, terminate your password, account, or use of this service (or any part thereof), and remove and delete any of your content within this service. You agree that the service provided under any provision of this Terms of Service may be interrupted or terminated without prior notice. You acknowledge and agree that FateTell Company may immediately close or delete your account and all related information and files therein, and/or prohibit further use of such files or this service. Furthermore, you agree that if the use of this service is interrupted or terminated, or your account and related information and files are closed or deleted, FateTell Company shall bear no liability to you or any third party.

V. Paid Services and Payment

5.1 Service Types

FateTell provides paid value-added services to you, including the following service types:

Subscription services: For example, "VIP Membership." After you pay the corresponding fees, you will enjoy specific membership benefits (such as unlimited use of designated AI characters, etc.) within a fixed subscription period (e.g., monthly, quarterly, or annual).
Per-use payment services: For example, purchasing a single consultation service or specific virtual items. After you pay a one-time fee, you obtain the right to use that service or item.

The specific service content, benefits, and prices are subject to the information published on the relevant service pages within the platform.

5.2 Payment Channels and Methods

You understand and agree that when purchasing paid services on this platform, you shall complete payment through the methods designated by us.

For iOS in-app purchases: If you make purchases through FateTell's iOS application (including subscriptions and per-use payments), you will pay through Apple's App Store In-App Purchase system. The processing, billing, and management of such payments will be governed by Apple's terms and conditions.
For web or other platform purchases: If you purchase through the FateTell website or other channels, you will pay through the third-party payment services designated by us at the time (such as Alipay, WeChat Pay, Stripe, etc.).

5.3 Subscription Services and Automatic Renewal

If you purchase a subscription service, certain services may adopt a "continuous subscription" (i.e., automatic renewal) model. When you purchase VIP Membership services through continuous subscription, unless you cancel the automatic renewal subscription or FateTell suspends or terminates the automatic renewal service in accordance with laws and regulations or this agreement, FateTell will charge you the service fee at the time of your subscription, and will automatically charge the subscription fee for the next subscription period from your payment account at a certain time before the expiration of the current and each subsequent subscription period.
You authorize FateTell to automatically deduct the fee for the next subscription period from your payment account (such as the payment method bound to your Apple ID or the payment channel you selected on the web) when your current subscription period is about to expire. When you purchase VIP Membership services through continuous subscription, you acknowledge and agree that you authorize FateTell, within the final period of the current and each subsequent subscription cycle, to automatically collect the subscription fee for the next subscription period from the payment account you selected before the expiration of the current subscription period. You shall ensure that FateTell can successfully deduct from your payment account. If renewal fails due to insufficient account balance or other reasons attributable to you, you shall bear the responsibility yourself.
Canceling automatic renewal: You may choose to cancel the continuous subscription at your own discretion. iOS users must manage this through the "Subscriptions" section in their Apple ID account settings by disabling the automatic renewal feature at least 24 hours before the end of the subscription period. Web users must cancel through the platform website's account settings or by contacting customer service before the end of the subscription period. If you wish to cancel the continuous subscription, you shall disable the automatic renewal feature a certain period before the subscription period expires, after which no further charges will be deducted.

5.4 Fees and Refund Policy

FateTell reserves the right to adjust service fees and promotional policies from time to time at its sole discretion. Any price adjustments will be communicated to you through platform announcements or notifications before the adjustment takes effect. For subscription services, price adjustments will take effect after the end of your current subscription period.
You acknowledge and agree that, given that paid services (whether subscription-based or per-use) are virtual digital goods and online services, upon successful payment, the service shall be deemed delivered or performance shall be deemed to have commenced. Accordingly, all payments are final and non-refundable. You shall have no right to request a refund of fees already paid for any reason, unless otherwise mandated by applicable laws and regulations.
You shall ensure that you are the owner of the payment account specified above, and that your payment activities do not violate any laws or regulations or infringe upon the lawful rights of others. You acknowledge and agree that FateTell provides no guarantees whatsoever regarding your payment account or payment activities. Losses and risks arising from your payment account due to causes not attributable to FateTell shall be borne by you personally.
When you purchase VIP Membership services through a one-time subscription, you shall pay the full service fee in one lump sum through the method stipulated in this agreement.

5.5 Other Benefits

Other benefits developed and periodically introduced by FateTell that are available to VIP members. You acknowledge and agree that the names and descriptions of the above service content may differ from the names or descriptions actually displayed on the relevant pages, but this shall not affect your normal use of VIP services. The content of VIP Membership services shall be subject to the content ultimately displayed on the VIP Membership page. Please review the relevant content carefully before making a purchase. When requirements under laws and regulations or from competent authorities change, FateTell may modify the content of this service accordingly. Additionally, in order to enhance and improve your service experience, FateTell may make improvements and adjustments to VIP Membership service content from time to time. VIP Membership services may not be gifted, transferred, or otherwise transacted between different accounts.

VI. Intellectual Property and Other Lawful Rights (Including but Not Limited to Reputation Rights and Goodwill Rights)

6.1 Protection of User Rights

If you believe that the use of another person's FateTell account (including the avatar, username, nickname, and profile of a FateTell account) infringes upon your lawful rights, please provide the following materials to FateTell Company in accordance with the instructions below. Please note: if the statements in the rights notice are untrue, the submitter of the rights notice shall bear all legal liability for the resulting consequences (including but not limited to compensation for all expenses and attorney's fees). 8.1 If any dispute arises between the parties regarding the content or performance of this agreement, the parties shall endeavor to resolve such dispute through amicable negotiation. If negotiation fails, the dispute shall be submitted to the Hong Kong International Arbitration Centre and resolved through arbitration in accordance with its then-current arbitration rules.

8.2 The failure of FateTell Company to exercise or enforce any right or provision of this Terms of Service shall not constitute a waiver of such right or provision.

8.3 If any provision of this agreement is wholly or partially invalid or unenforceable for any reason, the remaining provisions of this agreement shall remain in full force and effect.
